Digital Operations Legal Issues and Digital Dispute Resolution Mechanism

摘要

An increase in digital operations in the BRI countries poses a few complex legal, regulatory, and operational challenges. The difference in data protection laws, such as the EU GDPR and the Chinese PIPL, is a challenge to multinational companies and offers more grounds for conflict. The legal issues surrounding the use of digital operations are typified by technical sophistication, transnational forces, and electronic data, proving the limitations of the traditional dispute resolution process. The findings of this chapter reveal that new technologies, such as Online Dispute Resolution (ODR) platforms, blockchain, and smart contracts, can be used to propose new ways to effectively, transparently, and safely resolve digital disputes. They can be scaled and made available through the combination of technology automation and legal control, which is one of the ways through which conflicts can be resolved, particularly when cross-border cases are involved.
