Conclusion: Revitalizing Cooperative Consensus in a Diverse WTO

This concluding chapter synthesizes the core theoretical argument of the book and contends that consensus should not be abandoned or fundamentally altered. Far from being an inherent source of paralysis, the consensus rule provides the basis for legitimacy and predictable sovereign commitment when it is reframed away from an adversarial negotiating culture and understood as a shared governance responsibility. It first explains how cooperative consensus operates in practice, where sequenced progress and a functional tolerance of interim divergence help convert positional bargaining into problem-solving under conditions of strategic rivalry. It then situates this practice within the broader context of multilateral trade governance, highlighting how member-driven processes, supported by the Secretariat’s technical functions, the facilitative role of chairs and the leadership of the Director-General, enable iterative convergence despite structural diversity. The chapter concludes that the survival of rules-based multilateral governance depends on embedding these cooperative practices more systematically into everyday decision-making, thereby revitalizing the WTO’s capacity to act while preserving its foundational legitimacy.
