Recent Instances of Consensus Building: Services-DR, Fish I and the Internal Processes of IFD and E-Commerce JSIs

This chapter examines four recent negotiation settings across the WTO and plurilateral landscapes—the Services Domestic Regulation (SDR) JSI, Fisheries Subsidies Phase 1 and the internal processes of the Investment Facilitation for Development (IFD) and Electronic Commerce JSIs. Rather than viewing entrenched differences as precursors to gridlock, this chapter demonstrates how cooperative consensus can be actively constructed through incremental progress, interest clarification and flexible procedural design. It argues that consensus is not a static end-state, but an interactive, evolving process where dissent is utilized as a vital source of information to refine agreements rather than an obstruction to bypass. Across these four settings, institutional actors perform a critical enabling function. Instead of determining substantive outcomes, they exercise a form of process authority rooted in procedural neutrality, thereby transforming political divergence into structured, governable interaction. A significant insight of this chapter is that plurilateral settings can generate internal legitimacy and reproduce the underlying procedural logic of multilateral consensus-building. This approximation is actively constructed through deliberative practices such as procedural transparency, iterative drafting, and structured consultations. Finally, the chapter unpacks how a plurilateral outcome can be successfully integrated into the multilateral framework without diluting the substance of the disciplines or fracturing the WTO architecture.
