Building a Coherent Ethico-Legal Framework for End-of-Life Decisions in Malaysia

This chapter consolidates the central findings of the book and advances the reform argument for a coherent ethico-legal framework on end-of-life decisions in Malaysia. It reassesses the adequacies and inadequacies of the current Malaysian position in light of recent developments, particularly the 2024 Advance Care Planning Guide, the revised Malaysian Medical Council Consent Guideline and the National Standards for Palliative Care with Implementation Guide. While these instruments signify meaningful progress in professional guidance, advance care planning, consent, shared decision-making and palliative care standards, it is submitted that they do not yet amount to a complete regulatory framework. The discussion identifies the continuing need for clearer legal standards on withholding and withdrawal of treatment, symptom relief that may foreseeably hasten death, advance decisions, surrogate decision-making and mental capacity. It further situates end-of-life decision-making within the wider continuum of palliative care and highlights the importance of equitable access, cultural competence, quality improvement and resource-sensitive service delivery. The chapter concludes that future reform in Malaysia should therefore focus on consolidating existing professional guidance while developing legal safeguards on capacity, best interests, surrogate authority, documentation and protection of doctors who act in accordance with recognised professional standards.
