EU Digital Decarbonisation and AI Governance: Methane Regulation and the Future of LNG

摘要

Decarbonisation of existing business landscape presents a massive global challenge. Transition from fossil fuels to cleaner sources remains a bottleneck. Until renewables scale up, LNG serves as transition fuel due to its comparatively lower CO2 emissions, although its methane-related concerns remain. In 2024, European Union (EU) adopted regulations that introduce stringent monitoring, reporting and verification (“MRV”) and Leak Detection and Repair (“LDAR”) obligations across the energy value chain. Simultaneously, EU enacted Artificial Intelligence Act that introduces risk-based governance framework, possibly extending to AI tools used for MRV and LDAR compliance. This chapter argues that beyond the compliance-related burdens, the intersection and mandatory impositions under these two instruments serves as a powerful market signal for cleantech innovation and AI-solutions. It analyses how the new MRV and LDAR rules may accelerate the mainstreaming of blockchain, satellite-based and AI-driven solutions in LNG supply chain, giving rise to “LDAR-as-a-Service” and “MRV-as-a-Service”. It examines how challenges and opportunities differ for different cleantech firms. It evaluates the extraterritorial nature of the methane governance approach of EU and examines the role of ‘green LNG’ in energy security. The chapter finally evaluates the implications of convergence of these two laws and the emergence of a ‘Eurocentric’ decarbonisation framework.
