Constructing a Future-Proof Regulatory Framework for Gambling-like Elements Which Realises Children’s Rights

In this chapter, the insights from the children’s rights analysis are combined to discuss how a future-proof regulatory framework on gambling-like elements which realises children’s rights can be constructed. Three parts can be distinguished. The first concerns the substance of regulation or, in other words, what should be regulated? The ‘what’ in this question refers to gambling-like elements and behavioural design practices and is based on potential interferences with the children’s rights framework. The second relates to the instruments of regulation. To the extent that gambling-like elements should be regulated, how can this regulation be materialised and at what level? Third, the analysis discusses the implementation of regulation, referring to specific tools that can be used to implement existing or future regulatory instruments from the perspective of different stakeholders such as children, policymakers and videogame companies.
