Frameworks for Cooperation under the Rome Statute

This chapter examines the frameworks for cooperation under the Rome Statute, with a specific focus on the obligations of States Parties in cooperating with the Court and the challenges associated with non-cooperation. In addition, this chapter seeks to clarify the existing frameworks aimed at regulating State cooperation, identify obstacles to cooperation, and address the development of the law on non-cooperation as highlighted in case law. Divided into two parts, this chapter first outlines the provisions governing cooperation with the Court, followed by an analysis of case law on non-cooperation, and the development of the Court’s mechanisms for responding to and remedying such non-cooperation.
