摘要

This chapter analyzes the legal framework and judicial interpretations related to hate speech in Argentina. Although the Argentine Constitution does not explicitly address hate speech, discriminatory expressions are restricted through hermeneutic interpretations and laws. The chapter explores the Argentine Supreme Court’s position and key cases from Courts of various instances where the incitement of hatred based on race, religion, or nationality was a central issue, are also analyzed.Additionally, the role of international treaties with constitutional status in Argentina in shaping the legal responses to hate speech.
