Animal Law in Mexico: A Genealogical Approach to Speciesist Positivism

Animal law in Mexico is a subfield of the speciesist political system that reflects the discourse of domination. It is the result of the dialectical force that dictates “being is” “non-being is not” where non-human animals are reduced in a dialectic. Speciesist ideology treats animals as things, meaning-things, products, commodities or part of natural capital through instrumental rationalism of mediation. This dialectic conceals what the animal and its individuality are, and conceptualizes it according to its mediation value. Through a genealogical analysis of the regulatory system, the foundations of human-animal domination are revealed, providing critical elements to understand the misery of animals and the systematization of speciesism in the legal system as an animal right of domination. This analysis makes visible the historical-legal construction upon which animals have been reified and reduced in response to the interests of the oppressors.
