German Competition Law

This chapter provides an overview of German competition law and its evolving role in addressing competitive challenges in digital markets. It outlines the objectives of German competition law and the structure of the German Act against Restraints of Competition (ARC). Similar to European competition law, it is structured around three main pillars. The chapter then examines the German ban on cartels, with a particular focus on anti-competitive agreements in data-driven and digital markets. With regard to abuse control, the chapter highlights sec. 19a ARC, which introduces a special regime for undertakings of paramount cross-market significance for competition. Afterwards, German merger control is presented. The chapter concludes with an explanation of the enforcement structure.
