Hermeneutics, Historicism and Material Justice in the Interpretation of Law

This paper shows a vision of legal hermeneutics in historical perspective. A position that combines law and philosophy is addressed to better understand law in the theoretical and practical field. A position that combines legal hermeneutics and historicism to better understand the law in the theoretical and practical fields. The analysis of the problems of the relationship between norm and facts of the case and language helps to clarify the process of legal findings. In particular, attention is focused on the role of material justice in legal interpretation, which is contrasted with that of formal justice in the decision-making activity of the judge.
