The Works Council in Germany is the body elected by employees on the basis of the German Works Constitution Act (Betriebsverfassungsgesetz, BetrVG) to represent and enforce the interests of the workforce in companies. The Works Council and its members can influence the behavior of management or executives as well as that of employees in various ways according to the BetrVG and beyond. This chapter presents forms of influence of the Works Council and illustrates using the example of the corporate innovation and restructuring project in the SAM company, how the Works Council in Germany can promote the innovative behavior of employees and actively support the company in overcoming a real crisis situation, with particular attention to the specific legal context in Germany.
