Justifying the Late Punishment of Elderly Nazi Criminals from the Perspective of Punishment Theory

摘要

More than 70 years after the fall of the Nazi regime, elderly perpetrators are being held accountable before German criminal courts for their participation in murders. Can any good purposes be realised by punishing them after so much time has passed? As the present article argues, the answer to this question is yes. However, as preliminary deliberations from the perspective of punishment theory make clear, such a conclusion can only be a first step towards a more comprehensive justificationjustification of late punishment.
