Freedom and Responsibility in Law and Morality

  • Stephan Schleim

摘要

In this chapter, we deal with the “social logic” of our society. Historically and in comparison with other countries, we will see how this is subject to constant change. The crucial point is that the respective normative practices are useful, coherent and meaningful. Here, criminal law is particularly in focus. Concrete historical examples illustrate the possible derailments that a reduced understanding of what it means to be human can lead to. However, the door for a possible “criminal neurolaw” is not completely closed. In one country, it is already a reality.
