Plaintiff insurer undertook the insurance of the cargo owned by the cargo owner in respect of domestic transportation (water and inland carrier). The cargo was shipped by M.V. “Yong Da 158”, which was bareboat chartered and operated by Defendant. The cargo was damaged due to insufficient securing and lashing in the holds and the vessel’s taking ingress of seawater. The vessel, as escorted by M.V. Li An 368”, returned to the loading port and re-stow the cargo in order to resume the voyage. In the port of discharge, Plaintiff surveyed on the quantum of damage of the cargo and paid the insurance proceeds to the cargo owner.
