Cultural Heritage through the Lens of the Human Rights Committee and the Committee on Economic, Social and Cultural Rights

This chapter reviews the pronouncements of two human rights treaty bodies: the Human Rights Committee (HRC) and the Committee on Economic, Social and Cultural Rights (CESCR). It considers their pronouncements, which chiefly include their general comments, concluding observations, and views. The analysis pursues three goals: identifying (1) the meaning of cultural heritage in these pronouncements, (2) the rights asserted vis-à-vis cultural heritage, and (3) the corresponding state obligations that serve these rights and, more generally, cultural heritage.
