Deriving obligations from IHRL treaties not explicitly recognised in their texts is always in need of justification. In this section we will analyse the committees’ pronouncements with a view to identifying which justifications they rely on when discussing obligations of administrative procedure (8.1). We will find that the committees rely almost exclusively on instrumental justifications.
