(Adapted) Conditions According to Art. 49 et seq. DARS

In this chapter, the framework of countermeasures will be translated onto humanitarian military action against the backdrop of the different threads of international law and politics outlined in this research. Countermeasures offer a variety of conditions already set out in Art. 49 et seq. DARS. Some of these have to be adapted for humanitarian military measures while others can remain the same. The approach pursued is a result of the normative gap that needs to be filled, as demonstrated in Part I, and the different trends in emergence as outlined in Chap. 5.
