Between Liberalism and Confucianism: On Constitutionalism in South Korea

Examining South Korea’s dualist constitutionalism, this chapter analyzes judicial rulings on family-head systems to reveal tensions between individual dignity and relational goods. It critiques both liberal subordination of tradition and public reason Confucian constitutionalism as overly perfectionist, favoring proviso-guided negotiation for hybrid legitimacy. Consistent with the book’s pluralistic framework, it illustrates how translated Confucian reasons can sustain democratic stability without cultural erasure.
