Climate change has threatened the ecological balance and become a challenge to social and legal systems around the globe. Climate change has pushed humanity to the edge of planetary sustainability and become one of the greatest challenges including social, political and economic. The Greenhouse gases are increasing though international endeavours to curtail and bring the temperature in required Celsius through climate change policymaking and judicial bodies are striving to implement those policies and also contributing through judicial activism to control the consequences of climate change. The rule of law is an essential element of policymaking to fairly consider the GHG contributions and imposing policies for consequences. This paper delves into discussion on how environmental rule of law in policy making and climate adjudication assists to deal with these matters fairly. There are gaps in climate change policymaking which must be addressed at the adjudication stage such as considering vulnerability, human rights etc.
