The Role of the Commission in the Public Procurement Tool

This contribution outlines the main issues identified in relation to the Commission’s review of tenders for large public contracts based on notifications and declarations submitted under Regulation 2022/2560. This analysis addresses both the quantity and the quality of the submissions. The article assesses possible factors contributing to the higher-than-expected number of cases compared with initial projections anticipated during the legislative process and presents relevant statistical data. It also analyses the interaction between economic operators, contracting authorities, and the Commission as an important aspect of the procedure. The article concludes with an overview of the current situation and an outlook highlighting possible avenues for further action to enhance a level playing field in public procurement.
