Selected Discrimination Problems in the Application of Artificial Intelligence in Public Services

Artificial intelligence (AI) is increasingly being applied in public services such as social care, education, healthcare, and the justice system. While its implementation can enhance the efficiency and accessibility of these services, it also poses significant risks related to the discrimination of certain social groups. This issue often stems from biases embedded in training data, errors in algorithm design, and a lack of transparency in AI-driven decision-making. Examples from countries using such solutions show that the improper application of algorithms can lead to the systemic exclusion of minorities, individuals of lower economic status, or those from specific ethnic backgrounds. In response to these challenges, the European Union is developing regulations (the AI Act) aimed at ensuring that the use of AI complies with human rights and introduces obligations concerning transparency, human oversight, and risk analysis. To avoid discrimination, it is essential to design and implement technology responsibly, based on ethical principles, public consultation, and effective institutional oversight. Only such an approach can guarantee fair and equal treatment of citizens in the era of public service automation.
