Civil Liability Deriving from Artificial Intelligence Used in Air Navigation

The chapter aims to delve deeper into the topic of the civil liability deriving from Artificial Intelligence used in air navigation and to analyze the different models of responsibility. The question that lies at the centre of the debate is the source of the damage to persons or property caused by the algorithm incorporated in the device, which leads to an outcome that is unpredictable and not controllable by humans. There is a need to arrive at new forms of responsibility to guarantee adequate protection for victims of damage caused by machines equipped with artificial intelligence capable of self-learning. The issues subjected to critical examination are numerous. The work focuses on analyzing the Italian and European legislation on damages from aeronautical activities.
