The Impact of Digital Transformation on Judicial Institution Procedures: A Comparative Study

The study seeks to investigate the influence of digital transformation on the operations of the judicial organizations under this title (Digital transformation and the implications on the procedures of the judicial institutions), following that the judicial sector in the Arab World is witnessing a digital transformation with a high-speed rate in accordance with the needs of the digital age. Countries including Jordan and the UAE are working towards incorporating technology (such as remote trials and electronic notifications) in their justice systems to improve efficiency and expedite procedures. In Jordan, various laws like the Electronic Means System (2018) were introduced to enable online case filing and dispatching digital papers to the parties. Successful Remote Trials Through COVID-19 and for Prisoner Cases, Saved Costs and Security. Nevertheless, Jordanian law needs improvement to face new challenges including the determination of criminal responsibility in cybercrime. Meanwhile, the UAE has taken the lead in initiatives such as the Smart Court and Court C3, which merge the different stages of litigation in one hearing. The legislative revision has meanwhile acknowledged electronic signatures and digital documents as official evidence, setting the UAE as a precedent in the Arab region in enhancing transparency of the judiciary. The nations have similar issues, such as the lag between fast-paced tech developments and regulation, and a desire to protect party rights around contractual privacy and data tampering. In order to consolidate this change, the study recommends that Arab cooperation be expanded to exchange experience, modernize legislation to keep pace with future technologies, and create a secure digital infrastructure. The digitalization of the judiciary is a key element for the pursuit of efficient justice, but its implementation relies on the maintenance of a fine balance between updating and protection of legal rights.
