This chapter addresses a significant legal concern arising from the increasing prevalence of illegal firearms, particularly focusing on the evaluation of its underlying causes and potential solutions. The findings suggest that existing legislation fails to adequately address this issue due to certain ambiguously defined provisions, which inadvertently contribute to a rise in criminal behavior. Consequently, the research raises the question of whether the legal framework sufficiently safeguards the right to bear arms. Utilizing both descriptive and analytical methodologies, this study demonstrates that current laws are inadequate, especially in relation to offenses perpetrated by individuals utilizing firearms in ways that may incite criminal activity. It is recommended that the legislator revise the Weapons and Ammunition Law to establish a thorough legal framework that comprehensively addresses all associated issues. The law should be updated to incorporate various aspects of weapon usage and their associated risks to enhance protection and regulation.
