Dynamic Obligations: Patents and International Treaties

This chapter proposes the possibility of implementing dynamic obligations and brings in a hint of the ideal. Dynamic obligations are aimed at transforming society. This chapter deals with a proposal that could not be introduced: a patent waiver policy. Although an attempt was made to implement it, the response came too late. This chapter examines its implications. Continuing with other possible dynamic obligations, the chapter presents the draft versions of the international agreement signed by the World Health Organization (WHO). The many theoretical, practical and political challenges facing this new instrument are reviewed. Dynamic obligations show how the ideal must inform assessments and demands for change.
