The present contribution aims at illustrating Advocate General Wahl’s key contribution to the development of the case-law of the EU Courts on the Commission’s powers of investigation under Regulation No 1/2003 (requests for information, inspections and taking of statements). The Opinions of AG Wahl’s in this field appear guided by the need to reconcile justice and force: promoting the swift and effective enforcement of competition rules, while ensuring respect for the rights and principles which are at the heart of the EU legal system, such as proportionality, right of the defence and effective judcial protection.
