Conclusion: 2023 and the Difficult Quick Comeback

This chapter concludes with many of the unsolved problems of the past and the solutions proposed have not led to increased democratic stability. On the contrary, the current dilemmas remain putting the Brazilian political system in challenge. We approach the process of backsliding in Brazil and its halting in 2023. Brazil was a near miss in terms of coming very close to a democratic breakdown in 2022/2023. Yet, democracy survived. Ginsburg and Huq argue that under conditions of erosion, institutions and forces that are simply irrelevant in cases of democratic collapse may successfully militate against democratic failure. Additionally, Gamboa argues that the most important element of backsliding that allows for counteractions of the opposition is time (2022). This is how we read the capacity of Lula’s administration, the Supreme Court, and civil society actors to halt the attempt of Bolsonaro to break with the democratic order. Yet, we do not advocate for a quick comeback of democracy. On the contrary, we argue that the flawed designs of democratization in areas such as the political system, judicial system, and civil/military relation will continue to operate and haunt Brazilian democracy.
