The primary objective of this chapter is to refute the misconception that there are not any significant problems with civil and political rights in Mauritius by offering further guiding thoughts on the subject. It then shifts its focus to the Mauritian Constitution’s list of rights to look at how these rights have been interpreted thus far and how they have been granted judicial protection. The African Charter and other civil and political rights instruments under the African human rights framework are then contrasted with them. The goal is to draw attention to how and when these tools should be used to further the civil and political rights agenda at home.
