The Protection of Users of Digital Platforms and the Judicial Competences of AGCOM

Since its inception, the Italian Communications Authority - AGCOM, as the guarantor of the rights of users of communications services, has assumed the role of protecting the interests of users of such services, including from the perspective of “effectiveness,” by implementing mechanisms that are really alternatives to ordinary jurisdiction for resolving disputes with providers. The procedure as designed by the AGCOM, following its complete digitalization and the launch of the ConciliaWeb platform in 2018, has ensured such levels of efficiency and adaptability that its use is recommended even in areas under the Authority’s jurisdiction that were not previously covered by such mechanisms. Starting from these premises, the following chapter analyzes the tasks and functions that the Authority has recently assumed on the “judicial” side—understood as the administration of out-of-court proceedings aimed at ensuring the concrete protection of users’ interests—with regard to relationships between service users and digital platforms.
