This chapter addresses the digitalisation of public procurement in Italy, as formalised by the 2023 Public Contracts Code, which regulates the entire digital lifecycle of contracts. It distinguishes a ‘weak’ form (dematerialisation and digital management) and a ‘strong’ form (algorithmic decision-making). This shift raises key legal issues and redefines administrative legitimacy in the digital era.
