Upon a cursory analysis of the current international penal system, a paradox becomes evident: it is considered an international crime to destroy the environment during wartime—when almost everything is permitted—while the same conduct, if committed in times of peace, is not classified as a crime. Although this is clearly incongruent, it reflects the progressive development of international criminal law and the evolving relationship between humans and the environment.
