The impartiality and independence of the arbitral tribunal form the cornerstone of international dispute resolution, ensuring that parties have confidence in the process. However, neutrality can be compromised due to various underlying factors, including procedural inefficiencies and potential biases. This study explores the challenges faced in maintaining arbitrator impartiality, the methods by which biases manifest, and the policies that either facilitate or fail to prevent them. The discussion highlights the balance between fairness and efficiency in arbitration, proposing solutions to safeguard the credibility of international dispute resolution mechanisms.
