Justice of the Future, a Possible Transformation Through the Digitalization of Justice Procedures Using Artificial Intelligence
摘要
Conflict resolution accompanies and adapts to the evolution of society. In the beginning, social groups resolved their disputes through customary and unwritten laws. Over time, societies specialized their mechanisms for justice, creating legal instruments and judicial institutions. Today, we face new challenges, including the advent of artificial intelligence (AI) in legal decision-making, which raises profound questions about reason, empathy, and the human role in administering justice. This paper examines the historical development of the judicial institution, the implications of digital technologies, and the philosophical considerations of delegating justice to AI. While these tools promise efficiency and cost savings, they lack key human traits such as empathy and moral reasoning. Can a machine truly replace the judge? The answer may define the next milestone in this enduring institution.
