Girls’ Intersectional Analysis as a Critical Framework for Defining the Crime of Gender Apartheid

This chapter explores the systemic issue of gender apartheid through an intersectional lens, emphasizing its distinct impact on girls. While gender apartheid has been primarily examined in relation to women, this analysis underscores how girls experience compounded vulnerabilities due to the intersection of age, gender, socioeconomic status, and ethnicity. The chapter critiques the limitations of existing international legal frameworks, advocating for the explicit recognition of gender apartheid as a crime against humanity. It also examines manifestations of structural violence, including child marriage, educational exclusion, and gender-based violence, to highlight the need for targeted policies. By incorporating an intersectional approach, this study calls for a nuanced legal definition of gender apartheid that addresses the unique experiences of girls and proposes reforms to ensure accountability and justice.
