Bridging Legal and Institutional Gaps in the Protection of Conflict-Induced Internally Displaced Girls and Women from Sexual and Gender-Based Violence
摘要
The gravity of the problem of sexual violence against female displacees has inspired this discussion on the extent of physical and material protection available to them under the auspices of human rights law. This chapter examines the discrepancies between law and practice in guaranteeing the protection of female displacees and the challenges of transposing international and regional obligations into the Nigerian domestic legal corpus. The practicality of the available normative standards and the challenges of implementation have also been explored in this chapter. Socio-cultural factors and political contexts that foster the insensitivity of the government and other involved parties are considered. This provides a platform for proposing ways to bridge legal and institutional gaps in the protection of conflict-induced internally displaced girl and women from sexual and gender-based violence. The whole essence resides in its potential to draw attention to a set of concerns that otherwise may have been disregarded.
