Legal and Ethical Issues

This chapter provides a broad overview of the ethical issues surrounding family violence, anchored in the social determinants of health, as well as an introduction to the nurse’s role in post-violence. The forensic role of nurses (and the specialized field of forensic nursing) is described, spanning the life course from child abuse and neglect to older adult abuse and includes discussion of the legal and ethical obligations of nurses in regard to mandatory reporting. Mechanisms to promote safety for survivors (e.g., protection orders) and the role of nurses as witnesses in legal proceedings against perpetrators. A practical guide to the physical assessment of survivors of physical, sexual, and psychological abuse, introduces forensic nursing skills. Finally, we conclude with selected topics, including new ways in which Artificial Intelligence impacts nursing care for violence and abuse, which require nurses to apply these legal and ethical principles.
