Integrating Artificial Intelligence into goAML by Indonesia’s FIU: A Transnational Legal Process Approach to Combatting Terrorist Financing via Cryptocurrency Crowdfunding

Crowdfunding has become a significant fundraising tool globally and is expected to continue to grow in the coming years. However, Indonesia’s integration of Artificial Intelligence (AI) into the goAML platform for financial oversight operates without a comprehensive national legal framework for AI. This lack of regulation raises serious concerns about automated decision-making’s transparency, accountability, and legality in identifying suspicious financial transactions. In the absence of specific legislation on AI, the regu-latory basis relies on the Electronic Information and Transactions Law (Law No. 11 of 2008, amended by Law No. 19 of 2016), which regulates digital evidence and cybersecurity but does not address AI-specific risks such as algorithmic bias, explainability, or suitability. From a legal perspective, the implementation of AI in goAML must still comply with basic procedural measures, including the legal basis for data processing and protection against misuse of personal data.
