Foundations of the ‘Transdisciplinarisation’ of Law

This chapter lays the foundations for the concept of the transdisciplinarisation of law as a specific process of epistemological and educational reconstruction, distinct from the mere application of methods from other fields. Transdisciplinarity is presented objectively, and the core principles of transdisciplinary education are discussed, ranging from the interference of knowledge, the logic of the included third, intrinsic complexity and the dynamism of reality, to global vision and the transformation of the educator–learner relationship. The chapter also analyses the axes of transdisciplinary training, as proposed by CIRET and UNESCO, aimed at (re)connecting law—whose ties have been lost—with art, religion, technology and intercultural education, outlining the premises of a living, flexible and deeply relational legal science.
