Impartiality and Efficiency in International Arbitration: Grounds, Procedures, and Challenges in Arbitrator Disqualification

Disputes within nations are increasingly resolved through international arbitration rather than traditional court proceedings due to its efficiency, neutrality, and expedited resolution process. Arbitrators in both domestic and transnational contexts are expected to uphold impartiality and independence to maintain the integrity of the arbitration process. However, despite safeguards ensuring independence, the risk of arbitrator bias cannot be entirely eliminated. This report explores the necessity of impartiality and independence in arbitration and the challenges that arise when these principles are questioned. It further examines how perceived biases impact the duration and cost of arbitration, emphasizing the importance of addressing concerns related to arbitrator neutrality to uphold the credibility of international dispute resolution.
