Criminal Protection for Women from Indecent Acts Committed via Social Media

The spread of modern technology and social media has facilitated the commission of many crimes, in addition to the emergence of new types of crimes, some of which are classified as sexual crimes or honor crimes. While these crimes are commonly committed in their traditional form, the spread of modern technology has highlighted practices that may completely match the conventional form of crimes or even touch upon them in many aspects. This necessitates examining how legislation addresses these acts when committed vis cyberspace or through social media. This study examines the extent to which these crimes are perceived to be committed electronically or through social media. It also examines the position of Jordanian and Bahraini legislators when they are engaged through these means. The study concludes that it is possible to perceive this crime in its two forms: an indecent act and a request or offer of a lewd act. Furthermore, neither Jordanian nor Bahraini legislators have specifically provided for it in the Cybercrime Law, which means that traditional provisions in the Penal Code apply to it under the referral system contained in the Jordanian or Bahraini Cybercrime Law. The study concludes with several recommendations, the most important of which is the need to include these crimes in the Cybercrime Law, like other crimes such as online sexual exploitation and blackmail.
