Digitalisation, Artificial Intelligence and Sustainability in the Context of Sustainable Soil Management: The Future Role of Law and Governance?

This chapter explores the interplay between the emerging opportunities of digitalisation and Artificial Intelligence (AI) and Sustainable Soil Management (SSM). It focuses particularly on the role of legislation, regulatory frameworks, and governance mechanisms in guiding the responsible use of these technologies while addressing potential risks. To this end, the chapter first outlines the benefits and challenges associated with new digital tools in the context of SSM, with particular attention to the difficulties developing countries face in keeping pace with rapid technological advancements. It then examines the dimensions of the governance challenges, drawing on insights from a recent OECD study, and highlights the diverse legal instruments that must be considered. Before presenting its conclusions, the chapter briefly analyses selected regulatory approaches at both the international and national levels. Ultimately, the analysis underscores the need for a more inclusive and context-sensitive discussion on digital governance. Effective regulation must reflect the unique characteristics of emerging technologies, including AI, and be tailored to the sector-specific challenges that arise in their application.
