In July 2023, the Commission of the European Union (‘EU’) published its proposal for a regulation on plants obtained by certain new genomic techniques (‘NGT plants’) and their food and feed. According to the EU Commission the proposal is prompted by a significant demand in the Union and globally for NGT plants. It ascribes great potential to these plants in building up a more sustainable agriculture and food system which are resilient to the challenges coming along with climate change and biodiversity loss. Also, by supporting the use and application of new genomic techniques, the EU Commission hopes to decrease the EU’s external dependencies on imports of plant proteins which have been revealed by the Covid-19 pandemic and the Russian war against Ukraine. The EU Commission does not consider the current EU regulation on genetically modified organisms (‘GMOs’) adequate to regulate NGT plants, but needs to be adapted to scientific and technological progress.
