How Is the Principle of Transparency Enshrined in Current European Food Law?
摘要
In the first part, this chapter proposes a commented analysis of the General Food Law (“GFL”), moving from EU law to the specific EU food law domain. It further considers the policy issues behind its adoption to facilitate a wider understanding of the EU food law legal framework. Furthermore, after exposing the GFL structure and the “Fitness Check”, this section focuses on the amendments introduced by Regulation (EU) 2019/1381 (“Transparency Regulation”). There, the analysis deals with the description of transparency obligations and the application of the “dimensions” framework shaped in Chap. 1 . In the second part, this chapter investigates the judicial approach to transparency in the food sector. It examines how the CJEU Court of Justice of the European Union addresses transparency in its case law related to food (research question) by using software that supports qualitative content analysis (CAQDAS). Following an in-depth CJEU case law analysis, the chapter draws some conclusions. (This chapter contains also excerpts published in Vanuzzo (2021).).
