In light of the foregoing, we maintain that aporophobia cannot serve as a critical-criminological concept of penal selectivity, as it proves to be a failed category, lacking heuristic elements capable of translating its analysis into emancipatory critique. In other words, aporophobia as a critique of punitive power overlooks essential and sensitive elements necessary to grasp its latent structures.
