Constitutional Law and Politics in the Trump Era and The Future of Puerto Rico

Although the probability of major constitutional and political changes for Puerto Rico during the second Trump administration is low, Trump-appointed justices might help overturn the Insular Cases, because doing so would not much limit Congress’s power under the Territorial Clause. Because Puerto Ricans have now elected a pro-Trump governor and Puerto Ricans are an important voting bloc in Florida, Trump Republicans might see political advantages in granting Puerto Rico a greater measure of self-governance, despite Trump’s renewed embrace of American imperialism in the Western Hemisphere.
