The Significance of Law Pertaining to the Implementation of Servitisation in Business Models

The third chapter addresses the significance of law in the transition of business models from a product-oriented to a service-oriented framework. Initially, this chapter elucidates the relationship between law and the servitisation process. To achieve this, it conceptualises the terms ‘law’ and ‘legal norm’ while referencing the process through which these concepts are created. Furthermore, it examines legal risks, including those arising from their inherent unpredictability. Additionally, this chapter analyses legal regulations through a socio-technical lens, particularly in the context of emerging technologies associated with the provision of digital mobility services. It further explores the legal foundation and practical relevance of the principle of economic freedom as a cornerstone for engaging in business activities that involve offering digital mobility services, alongside the legal constraints that may impede such services. Lastly, the chapter outlines the essential considerations concerning the evolution of the legal framework governing the provision of digital mobility services, as well as the legal sources pertaining to these services as forms of e-commerce.
