The Legal Framework for Trademark Protection in the Metaverse: A Comparative Analysis Between the UAE and the USA

The metaverse has become an opportunity for trademark owners to contribute to building attractive societies for investment, and the research aims to conduct a legal study of some forms of legal protection for trademarks in the metaverse world through an analytical study of United Arab Emirates law compared to American law. The research included a study of the nature of trademark protection in the virtual metaverse world and the mechanisms of its use, and the research, on the other hand, included the issue of trademark registration in the metaverse world through the American experience so that it can be emulated in UAE law. The importance of the research lies in the fact that most trademark protection laws are still inadequate to protect these rights in violations of the metaverse world, and they are also insufficient to clarify the mechanism of trademark registration. At the end of the research, we reached a set of conclusions, the most important of which is that the protection of trademarks in the world of metaverses needs the intervention of the UAE legislator so that issues related to this type of commercial transaction can be dealt with and then work to implement a new system to protect the rights of trademark owners from attacks and violations in the metaverse world. The most important recommendation is the need to work on the establishment of a special and unified law on trademark rights in the metaverse world, which works to regulate penalties and penal procedures if violations or attacks on these rights are committed in the metaverse by one of the users of the avatar, which is the digital avatar, which is representative of the person used to perform his task within the metaverse.
