Women accused of criminal activity are a minority population in the criminal justice system. A consequence is that programs are less likely to be available for women than to their male counterparts. However, the number of women subject to incarceration is rising, resulting in a need for the state to pay them more attention. This chapter canvasses the move from retributive punishment to therapeutic jurisprudence by reference to female criminal offending in particular. It explores the potential of rules affecting the grant of bail in Magistrates Courts in Queensland, Australia to defendants under a Court Link Program. This bail-based program is designed to assist defendants alter their life circumstances by helping them to reorientate away from activities or omissions that result in their contact with criminal courts. Positive lifestyle change, helped by case management and Court Link staff support, is provided with some immediacy. Ultimately, where the defendant is found guilty or pleads guilty, successful efforts on the program operate as a factor to reduce sentence. The outcomes from the Court Link Program show that it is working successfully with women defendants.
