This article explores the evolving legal framework governing neurotechnology within Brazil's digitalized health system. The analysis begins with an examination of Brazil’s healthcare digitalization policies, emphasizing the critical role of data protection as a foundational and reflective framework in this context. It then provides an overview of state policies and regulatory frameworks related to telemedicine and human research, highlighting their potential adaptations to accommodate neurotechnologies. Finally, the article addresses the emerging perspective on neurorights, with a focus on Brazilian and broader Latin American legal initiatives. The discussion concludes by underscoring the imperative of a cross-updating of the regulatory system, particularly concerning healthcare, medical practice, and research, with specific attention to neurotechnologies incorporating artificial intelligence.
